Can you sell before handover?

Usually yes, but your SPA governs it. Developers set conditions for assignment, commonly that a minimum portion of the price has been paid and that the account is up to date. Some restrict resale for a set period after launch. Find the assignment clause in your SPA and ask the developer for its current policy and fees in writing before you list.

The process step by step

1. Check eligibility with the developer: amount paid, arrears, any restrictions. 2. Price the unit: compare with the developer's current price for similar units and recent off-plan resales in DLD data (reading DLD transaction data). 3. List with a licensed agent using a Form A and a valid advert permit. 4. Agree terms with a buyer in Form F, stating the amount paid to the developer that the buyer will reimburse, any premium, and who pays fees. 5. Developer NOC: the developer confirms it consents and states the outstanding balance (developer NOC explained). 6. Transfer at the developer's office or a trustee office: the buyer pays the seller, DLD fees are paid, and the Oqood registration moves to the buyer, who signs up to the SPA.

How the money works

On an off-plan resale the buyer typically pays the seller the amount the seller has already paid the developer plus any agreed premium (or minus any discount). The buyer then continues paying the remaining instalments to the developer under the original plan. The DLD transfer fee applies to the transaction — ask the trustee office or developer how it is calculated for an off-plan resale and who pays under your Form F. The developer charges its own transfer or admin fee. Confirm all figures before you set your price.

If you are the buyer

Buying an off-plan resale can give you a unit in a sold-out project, or a shorter wait. Check:

  • the seller's Oqood registration and payment history with the developer
  • the outstanding balance and remaining schedule (off-plan payment plans)
  • the project on the Dubai REST app (how to verify a developer)
  • whether any post-handover plan transfers to you
  • the SPA terms you will inherit, including delay and specification clauses

Risks for sellers

  • Developer conditions not met when a buyer is ready
  • Competing with the developer's own unsold stock
  • Market changes during construction reducing achievable price
  • Fees and premium expectations eroding the gain
  • Missing an instalment while marketing, which can block the NOC

Returns are never guaranteed. If selling is your plan from day one, factor these risks in before you buy, using the off-plan due diligence checklist.

Who does what

The seller confirms eligibility, keeps instalments current and signs the transfer. The buyer funds the reimbursement and fees and takes on the SPA. Agents market, prepare Form F and coordinate. The developer issues the NOC, updates its records and collects its fee. DLD registers the transfer of Oqood. For ready-property sales instead, see how to sell property in Dubai.

Questions people ask

Can I assign my off-plan unit at any time?

Only when the SPA and developer conditions allow it. Many developers require a minimum amount paid first. Check your SPA and ask the developer.

Who pays the DLD fee on an off-plan resale?

Usually the buyer, as with other transfers, but it is set by Form F. Confirm how the fee is calculated with the trustee office or developer.

Can I sell off-plan if I still owe the developer money?

Yes, provided the developer's conditions are met. The buyer takes over the remaining balance and payment plan.

Is an off-plan resale cheaper than buying from the developer?

Sometimes, sometimes not. It depends on the premium the seller asks and what the developer is currently offering. Compare both.

Do I need the buyer's mortgage approval before signing?

If the buyer needs finance, yes — and note that fewer banks lend on off-plan resales. Build realistic timings and a finance condition into Form F.
