Developer NOC explained
What a developer NOC is in a Dubai resale, why the trustee office needs it, who applies and pays, what can delay it, and how buyers and sellers should plan.
- Issued by
- The master or project developer
- Needed for
- Registering a resale transfer at DLD
- Who applies
- Normally the seller or their agent
- Main condition
- Service charges and developer dues paid up
- Fee
- Set by each developer — confirm directly
What the NOC does
Dubai's freehold communities are governed by master developers and, inside them, building owners' associations managed through Mollak. Before a property changes hands, the developer confirms there is nothing outstanding that should stop the transfer: unpaid service charges, unpaid instalments (for off-plan), unapproved alterations, or other dues. The NOC is that confirmation. DLD's trustee offices will not register a resale without a valid one, so the NOC is often the step that sets the completion timetable.
Who applies and who pays
The seller (or the seller's agent) applies to the developer, usually online or through the developer's customer service. The developer charges a processing fee, which varies by developer and can differ for ready and off-plan units; ask for the current fee. By market practice the seller pays, but Form F should state it. The buyer's details are required on the application, which is why the NOC is applied for after Form F is signed. See Form F explained.
Step-by-step
1. Buyer and seller sign Form F. 2. Seller clears service charges; check the current Mollak statement (service charges explained). 3. Seller submits the NOC application with title deed, passports, Form F and fee. 4. Developer checks the account and any alterations; it may request an inspection. 5. Developer issues the NOC, which is valid for a limited period printed on it. 6. Transfer is booked at the trustee office before the NOC expires.
What delays an NOC
- Unpaid service charges, including recent invoices not yet visible to the seller
- Unapproved modifications such as enclosed balconies or structural changes
- Name mismatches between passport, deed and application
- For off-plan resales, instalments not paid to the developer's required level — see selling or assigning off-plan
- An expired NOC because the mortgage or funds were not ready, forcing a reapplication
What buyers should check
As a buyer you rely on the NOC to know service charges are clear, but ask to see it before transfer day and check that the names, unit and validity dates are correct. Ask for the latest service-charge statement and whether any special levy has been announced for the building. If you are mortgaging, your bank also needs the NOC and may need it earlier. The full sequence is in how to buy property in Dubai and conveyancing in Dubai.
Who does what
The seller applies and pays and clears dues. The buyer supplies identity documents for the application and confirms financing is ready within the NOC validity period. Agents chase the developer, collect documents and book the trustee appointment. The developer verifies the account and issues the certificate. The trustee office checks the NOC is valid on the day. If you are selling, plan the NOC early; our how to sell property in Dubai guide shows where it fits.
How long the process can take
Timing varies by developer and by how clean the file is. Some developers process online applications quickly; others need an inspection or extra documents. Ask your agent which developer is involved and what its current turnaround is, then build that into the Form F completion date.
Questions people ask
Does every Dubai property need a developer NOC to transfer?
Most freehold resales do. Requirements can vary by community and developer. Your agent or trustee office will confirm what DLD requires for the specific property.
How long is an NOC valid?
Each developer sets a validity period, printed on the certificate. Book the transfer within it; otherwise you may need to reapply and pay again.
Can the buyer pay the NOC fee?
Yes, if both parties agree and write it into Form F. By market practice the seller pays.
Is an NOC needed for an off-plan assignment?
Yes. Developers have their own process and conditions for off-plan resales, often linked to how much of the price has been paid. Check the SPA and ask the developer.
Does the NOC confirm the property has no defects?
No. It confirms the developer has no objection to the transfer, mainly because dues are paid. Inspect the property separately using a viewing checklist.
