What freehold means

Freehold ownership gives you the property outright and indefinitely, registered with the Dubai Land Department on a title deed in your name. You can sell, lease, mortgage and pass it on, subject to Dubai law and community rules. In apartment buildings you own your unit plus a share of common areas, which are run under the jointly owned property law (Law No. 6 of 2019) with service charges administered through Mollak. Outside freehold areas, non-UAE nationals generally cannot own property outright; leasehold and usufruct rights are different arrangements — see freehold vs leasehold in Dubai.

Examples of freehold areas

Freehold areas have been designated across the city, from waterfront districts to suburban villa communities. Widely known examples include:

Many other master communities are freehold too, but we do not publish a full list because designations and project boundaries need checking case by case. Browse our area guides and confirm status for any property you shortlist.

How to check a specific property

1. Ask the agent to confirm in writing that the property is freehold for non-UAE nationals. 2. Verify the title deed (resale) or project registration (off-plan) on the Dubai REST app. 3. For off-plan, confirm the developer and project are registered and have an escrow account — see how to verify a developer on Dubai REST. 4. If anything is unclear, ask DLD or the trustee office before signing Form F or an SPA.

Freehold is not the same as a good investment

Freehold status only tells you that you can own the property. It says nothing about price, rental demand, service charges or build quality. Weigh those separately: read best areas to invest in Dubai, compare off-plan vs ready property, and review service charges before you commit.

Who does what

DLD designates and records freehold status and registers ownership. Developers market projects within those zones and register off-plan sales. Your RERA-licensed agent should confirm status and pass on documents. The trustee office checks eligibility at transfer. If the buyer is a company, additional rules about the type of entity apply, so take legal advice.

Common mistakes

  • Assuming a whole district is freehold because one tower in it is
  • Relying on marketing brochures instead of DLD records
  • Confusing long-term leasehold with freehold ownership
  • Buying through informal nominee arrangements to get around eligibility rules — this is risky and can leave you without legal title

Freehold, community rules and your rights

Owning freehold does not mean you can do anything you like with the property. Master community rules, building regulations and the owners' association set what you can change, how you can use the property and what you contribute through service charges. Alterations generally need developer or community approval, and unapproved works can delay a future sale. If you plan to let the property short-term, a Department of Economy and Tourism holiday-home permit is required, and some buildings have their own restrictions. Read the community rules before you buy, not after.

Questions people ask

Can foreigners buy anywhere in Dubai?

No. Non-UAE nationals can own freehold only in designated areas. Elsewhere other rules apply. Confirm the status of each property with DLD or your agent.

Is Dubai Marina freehold?

Yes. Dubai Marina is one of the well-known freehold areas, along with Downtown Dubai, Palm Jumeirah, Business Bay, JVC, JLT and Dubai Hills Estate.

Does freehold ownership give me a visa?

Not by itself. Investors whose property meets DLD's AED 2 million threshold may qualify for a Golden Visa; check current criteria. See Golden Visa through property.

What happens to freehold property when the owner dies?

It passes according to law and any registered will. Plan ahead — see wills and inheritance for Dubai property.
