Start with the contract

Open your tenancy contract and any addendum and look for wording on early termination. Many Dubai contracts include a clause allowing the tenant to leave early by giving a set notice period and paying compensation, often expressed as a number of months' rent. If that clause exists and you follow it exactly, the exit is usually straightforward.

Note whether notice must be given in a particular way, such as by email to a named address, and whether the penalty is on top of rent for the notice period.

If there is no early termination clause

Without a clause, the contract runs for its full term and you are generally committed to paying for it. That does not mean you are stuck. It means you need the landlord to agree. Most landlords prefer a negotiated exit to an empty unit and a dispute, especially if you help them re-let quickly.

If you cannot agree, the Rental Dispute Centre is the forum, but take advice first, as a case may cost more than a settlement.

How to negotiate a fair exit

  • Give as much notice as you can, in writing.
  • Offer to allow viewings at short notice and keep the property presentable.
  • Propose a replacement tenant if you know one, though the landlord does not have to accept them.
  • Offer compensation that reflects the landlord's realistic re-letting time.
  • Ask for uncashed cheques to be returned once the settlement is paid.

Agree everything in a short written settlement: the leaving date, the amount, how the deposit will be handled and which cheques come back.

Job loss and relocation

People often need to leave because an employer moves them or a job ends. Unless the contract specifically says so, these are not automatic grounds for ending the lease without penalty. If your employer holds the lease, read renting with a company lease, as the company may handle the termination and its cost.

Closing everything down

Once the exit is agreed, work through the admin in order:

  • Cancel the Ejari registration, or ask the landlord to, so the next tenant can register.
  • Close the DEWA account and any chiller or gas accounts; keep the final bills. See DEWA connection for tenants.
  • Return access cards, parking stickers and keys against a signed note.
  • Do a joint inspection and compare it with your move-in photos to support your security deposit return.
  • Apply for a building move-out permit if your building requires one.

Protecting yourself

Do not simply stop paying and leave. Bounced or stopped cheques can expose you to claims and complicate future rentals, visas and banking. Keep copies of every message. A clear paper trail is the best protection if anyone later disputes what was agreed.

Questions people ask

Can I break my lease early in Dubai?

Yes, if your contract has an early termination clause or the landlord agrees. Without either, you are generally bound for the full term and should negotiate a settlement.

What is the usual penalty for early termination?

There is no single legal figure for residential leases; it depends on your contract or what you negotiate. Contracts often express it as a number of months' rent.

Do I get my deposit back if I leave early?

You should, less any agreed compensation and genuine damage, provided the settlement says so. Make the deposit treatment part of the written agreement.

Can the landlord refuse a replacement tenant?

Yes. Unless your contract says otherwise, the landlord is free to choose the next tenant. Offering one simply makes a negotiated exit more likely.

Will the landlord return my uncashed cheques?

They should return cheques for the period after your agreed exit once the settlement is paid. List the cheque numbers in the agreement.

Does a job loss let me end the lease?

Not automatically. Unless the contract includes such a clause, it is a matter for negotiation with the landlord.
